For electronic contracts, the terms will be provided in such a way that they can be stored and accessed.
If there is any conflict between general terms and specific terms, the provision most favourable to the consumer shall prevail.
If any provision is invalid, the remaining provisions shall remain in force and a replacement provision shall apply.
Situations not covered by these terms shall be interpreted in accordance with these terms.
Any ambiguity in interpretation shall be resolved in line with these terms.
Article 4 – The Offer
If an offer is subject to a limited period or special conditions, this will be expressly stated.
Offers are non-binding. The trader may amend or withdraw an offer.
The offer contains a complete and accurate description of the products/services. Images are for illustrative purposes only; colours may vary depending on screen settings.
The consumer will receive clear information about:
- Price (excluding customs duties and import VAT, which are payable by the buyer)
- Shipping costs
- How the contract is concluded
- Whether a right of withdrawal applies
- Payment, delivery, and performance arrangements
- Acceptance period and price validity
- Costs of distance communication (if different from the standard rate)
- Whether the contract is archived and how the consumer can access it
- The possibility to check and correct entered information before submitting the order
- Available contract languages
- Any codes of conduct to which the trader is subject and how these can be consulted
- Minimum contract duration for ongoing contracts
- (Optional) available sizes, colours, and materials
Article 5 – Conclusion of the Contract
The contract is concluded once the consumer accepts the offer and complies with the stated conditions.
For electronic contracts, the trader will confirm receipt of the acceptance electronically. Before this confirmation, the consumer may withdraw the acceptance.
The trader will take appropriate security measures for electronic transactions.
The trader may assess the consumer’s ability to meet payment obligations and may reject an order or accept it subject to special conditions on reasonable grounds.
Upon delivery or on a durable medium, the trader will provide:
- The trader’s address for complaints
- Information about the right of withdrawal or its exclusion
- Information about guarantees and after-sales service
- The details referred to in Article 4, if not already provided
- Cancellation terms for ongoing contracts
For ongoing contracts, the above information will only be provided with the first delivery.
All contracts are subject to product availability.
Article 6 – Right of Withdrawal
The consumer has the right to withdraw from the purchase of a product within 14 days without giving any reason, starting from the day after receipt.
During the withdrawal period, the product and packaging must be handled carefully and only used as necessary to establish the nature and characteristics of the product.
To exercise the right of withdrawal, the consumer must notify the trader in writing within 14 days (email is sufficient) and return the product within 14 days after such notice, including proof of return shipment.
If no notice or return is made within the stated periods, the purchase becomes final.
Article 7 – Costs in the Event of Withdrawal
The consumer bears the cost of return shipping.
If payment has already been made, the trader will refund the amount as soon as possible and no later than 14 days after withdrawal, provided the goods have been received or proof of return has been supplied.
Article 8 – Exclusion of the Right of Withdrawal
The right of withdrawal may be excluded for certain products/services if this is clearly stated before purchase.
This exclusion applies to:
- Products made to the consumer’s specifications or clearly personalised
- Products which, by their nature, cannot be returned or are liable to deteriorate rapidly
- Newspapers/magazines, audio/video software, or hygiene products where the seal has been broken
The exclusion for services applies to:
- Accommodation, transport, catering, or leisure services for a specific date or period
- Services where performance has begun with the consumer’s express consent before the withdrawal period has expired
- Games and lotteries
Article 9 – Prices
Prices remain fixed during the validity period of the offer, except for changes in VAT rates.
Variable prices may apply where market changes require this; this will be stated accordingly.
Price increases within 3 months are only permitted where they result from legal changes.
Price increases after 3 months must be communicated and give the consumer the right to terminate the contract.
Delivery takes place outside the EU; import VAT and customs duties will be collected by the shipping partner.
Prices are subject to printing errors. The trader is not obliged to supply at an incorrect price.
Article 10 – Product Conformity and Guarantee
The trader guarantees that the products/services comply with the contract, reasonable expectations, and applicable legal requirements.
Manufacturer or importer guarantees do not affect the consumer’s statutory rights.
Defects or incorrect deliveries must be reported in writing within 14 days and returned in undamaged, unused original packaging.
The guarantee will be void if:
- The consumer or a third party has repaired or modified the product
- The product has been mishandled or used contrary to the instructions
- The defect results from government regulations concerning the quality of materials
Article 11 – Delivery and Performance
The trader will process orders with the greatest possible care.
Delivery will be made to the address provided by the consumer.
Orders will be fulfilled as quickly as possible and no later than 30 days, unless otherwise agreed. In the event of delay or incomplete delivery, the consumer will be informed within 30 days and will have the right to withdraw from the purchase and receive a refund within 14 days.
If delivery is not possible, a replacement product may be offered; the right of withdrawal remains unaffected.
The risk of damage or loss passes to the consumer upon receipt.
Article 12 – Ongoing Contracts: Termination and Renewal
-
Termination:
The consumer may terminate open-ended contracts or fixed-term contracts for the regular supply of products/services at any time, subject to a notice period of no more than one month. -
Renewal:
Fixed-term contracts may not be renewed automatically, except in specific cases involving certain products (for example, magazines). -
Duration:
For contracts lasting more than one year, the consumer may terminate the contract after one year with one month’s notice, unless otherwise agreed.
Article 13 – Payment
Unless otherwise agreed, payment is due within 7 working days after the start of the withdrawal period.
The consumer must report any errors in payment details without delay.
In the event of non-payment, the trader is entitled to charge reasonable costs, provided the consumer has been informed in advance.
Article 14 – Complaints Procedure
Complaints must be submitted in writing, with a clear description, within 7 days of discovery of the defect.
Complaints will be answered within 14 days. If more time is needed, the consumer will be informed accordingly.
If the complaint cannot be resolved, a dispute will arise and will be handled under the dispute resolution procedure.
Complaints do not release the consumer from the obligation to pay, unless otherwise agreed.
If a complaint is justified, the product will be replaced or repaired free of charge.
Article 15 – Disputes
Contracts governed by these terms are subject to Dutch law, regardless of the consumer’s place of residence.
Article 16 – CESOP
In accordance with the 2024 Payment Service Provider Directive (CESOP) provisions, payment service providers may record data in the European CESOP system.
